What does foreclosure mean?
Foreclosure is a process that allows a lender to recover the amount of money owed on a defaulted loan by selling or taking ownership (repossession) of the property in order to secure the loan. What is a short sale?
A short sale or negotiated settlement (also known as "short pay") occurs when a lender agrees to accept less than the amount owed to payoff a loan as an alternative to foreclosure. If the property is worth less than the amount owed on the loan, then even if the lender forecloses and takes back the property, they know they are going to take a loss. The short sale negotiation process is a lengthy one; it may take several weeks or, more likely, several months to get an approval. A short sale may reflect negatively on a credit report for approximately two years.
In the short sale process, you must be aware of two different terms:
• "Release": A lender may offer to "release" its security interest against the property in exchange for less than the total amount of the note. A release will allow the property to be sold without paying off the full obligations of the note. However, the note is not satisfied. The remaining debt on the note, sometimes called "deficiency," still exists. You are still liable for the full balance of the note.
• "Satisfaction": A lender may agree to accept less that it is owed as complete and total satisfaction of the note and releases its liens against the property. When the property is sold, the debt is paid off completely. You may have some tax consequences that you should discuss with your tax advisor.
What is an REO?
REO stands for "Real Estate Owned." These are properties that have gone through foreclosure without a successful sale and are then reverted back to the bank, lender or the mortgage company. The mortgage loan no longer exists. What is a lease?
A lease is a legal, binding agreement that an individual enters into when renting from an owner. Once it is signed, you are legally held responsible for fulfilling its terms. For example, the lease will include the names of the tenant(s), the amount of rent, security deposit, length of lease and a list of utilities not included.
Association approval required for renters: Most Boston area condominiums require prospective tenants to be approved by the association prior to moving into the unit. Most condo associations will also require and run a background check along with a credit check on each prospective tenant. The approval process usually takes between one and three weeks, and you must anticipate this lapse of time in your rental strategy. The average cost for association applications runs from $100 to $200 and must be paid to the condominium association itself.
Amount of rent and utilities: The amount of rent that you will be paying each month must be expressly written and agreed to in the lease. Be pragmatic and realistic about your budget. Don't forget to think about extra expenses that aren't included in the maintenance fees paid by the landlord, such as cable TV, Internet, home phone, parking, renter's insurance and in most situation gas, oil and electricity.
Security deposit and advance monies: Most owners will require you to put down a security deposit to cover any expenses that they might incur during and following your tenancy. The amount of the security deposit is usually a full month's rent.
You will hear "first, last and security" a lot. In fact, the majority of leases require three months worth of rent paid before moving in-the first month and the last paid ahead, along with a one-month security deposit, which is fully refundable once you move out as long as the terms of the lease have been respected and that no damage more than regular wear and tear are noticed by the landlord.
Length and terms of lease: The length of your lease may be anywhere from six months to one year. You will be responsible for fulfilling your lease for the entire duration of your lease terms.
